Terms of Service

1. Agreement

These Terms of Service ("Terms") form a legal agreement between you and YOM Digitals Limited ("we", "us", "MorphCam"), governing your use of the MorphCam application and related services. By creating an account or using MorphCam, you accept these Terms. If you do not agree, do not use MorphCam.

2. Eligibility

You must be at least 18 years old, or the age of legal majority in your jurisdiction, to use MorphCam. By using the Service you confirm that you meet this requirement.

We ask for your date of birth when you sign up, and once from accounts created before we started asking. We may ask you to confirm your age at any time. If we learn that an account belongs to someone under 18, we will close it.

3. Accounts

You are responsible for the accuracy of the information you provide and for keeping your account credentials secure. You are responsible for all activity that occurs under your account. Notify us promptly of any unauthorized use.

You must verify your email address with the one-time code we send you before you can buy credits or stream. Creating fake or multiple accounts to get around our rules or abuse the partner program is not allowed.

4. Acceptable use

Your use of MorphCam is governed by our Acceptable Use Policy, which is incorporated into these Terms by reference. Violation of that Policy is a violation of these Terms.

MorphCam is for creators, streamers and entertainment, and any AI character you use must always be disclosed as AI. Among other things, you must not use MorphCam for fraud; to impersonate any real person; to pass or get around identity, age or KYC verification; for sextortion, harassment or hate; for sexual content involving real people; or for anything involving minors. The Acceptable Use Policy sets out the full rules.

If you take part in the MorphCam partner program, our Partner Program Terms also apply.

5. Credits and payment

1. MorphCam operates on a credit system. Streaming consumes credits at a rate of 2 credits per second.
2. Credits are purchased through credit packages. Prices are displayed in US Dollars within the application.
3. Payments are made inside the MorphCam app, either in cryptocurrency (Bitcoin, USDT, USDC, ETH or BNB), through our crypto payment provider ("Pay instantly") or by sending the coins yourself ("Pay manually"), or in Naira by bank transfer. Naira prices are shown in Naira at our current exchange rate at the time of purchase. We do not process payments on this website.
4. Instant payments are confirmed automatically once the transaction is confirmed on the blockchain, usually within a minute (Bitcoin can take up to an hour). Manual payments are confirmed by our team, which can take 5 hours or more. For Naira bank transfers, you upload your payment receipt and our team confirms it. Credits are issued to your account once your payment has been confirmed.
5. Cryptocurrency payments are non-reversible. Once a payment is sent, it cannot be cancelled or recalled, and you are responsible for sending the correct amount to the correct address.
6. Credits do not expire.
7. Credits are non-refundable once purchased. If a technical fault attributable to MorphCam prevents you from using credits you have paid for, contact support@usemorphcam.com and we will restore the affected credits or issue a refund for the affected amount, at our discretion.
8. We may change credit package pricing at any time. Changes do not affect credits already purchased.

6. Service availability

MorphCam relies on third-party infrastructure, including AI processing provided by Decart. We aim to keep the Service available and reliable, but we do not guarantee uninterrupted access. The Service may be temporarily unavailable for maintenance, updates, or reasons beyond our control.

7. Intellectual property

MorphCam, including its software, design, and branding, is the property of YOM Digitals Limited. These Terms do not grant you any ownership rights in the Service. You retain ownership of the original content you create using MorphCam, subject to your compliance with these Terms and the Acceptable Use Policy.

8. AI processing disclosure

MorphCam uses third-party AI face transformation services to process your webcam video in real time. By using MorphCam, you acknowledge and accept the following:

1. AI processing is performed by an underlying third-party provider. MorphCam transmits your video stream to that provider solely to deliver the transformation feature.
2. By using MorphCam, you acknowledge and accept this processing.

9. Termination

We may suspend or terminate your account, with or without notice, if you violate these Terms or the Acceptable Use Policy. You may stop using MorphCam at any time. Credits associated with an account suspended or terminated for a policy violation are forfeited and are not refunded.

We cooperate with law enforcement. We may report unlawful activity and share relevant account, payment and usage information with the authorities where the law requires it, or where we believe in good faith that it is needed to prevent fraud or protect someone from harm.

10. Disclaimers

MorphCam is provided "as is" and "as available", without warranties of any kind, whether express or implied, to the fullest extent permitted by law.

11. Limitation of liability

To the fullest extent permitted by law, YOM Digitals Limited shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of, or inability to use, MorphCam. Our total liability for any claim relating to the Service shall not exceed the amount you paid to us in the three months preceding the claim.

12. Changes to these Terms

We may update these Terms from time to time. We will update the "Last updated" date above. Continued use of MorphCam after changes take effect constitutes acceptance of the revised Terms.

13. Governing law

These Terms are governed by the laws of the Federal Republic of Nigeria.
