Terms of Service

1. Agreement

These Terms of Service ("Terms") form a legal agreement between you and YOM Digitals Limited (RC 8913694) ("we", "us", "MorphCam"), governing your use of the MorphCam application and related services. By creating an account or using MorphCam, you accept these Terms. If you do not agree, do not use MorphCam.

2. Eligibility

You must be at least 18 years old, or the age of legal majority in your jurisdiction, to use MorphCam. By using the Service you confirm that you meet this requirement.

3. Accounts

You are responsible for the accuracy of the information you provide and for keeping your account credentials secure. You are responsible for all activity that occurs under your account. Notify us promptly of any unauthorized use.

4. Acceptable use

Your use of MorphCam is governed by our Acceptable Use Policy, which is incorporated into these Terms by reference. Violation of that Policy is a violation of these Terms.

5. Credits and payment

  1. MorphCam operates on a credit system. Streaming consumes credits at a rate of 2 credits per second.
  2. Credits are purchased through credit packages. Prices are displayed in Nigerian Naira within the application.
  3. Payments are processed by Paystack. We do not store your card details.
  4. Credits do not expire.
  5. Credits are non-refundable once purchased. If a technical fault attributable to MorphCam prevents you from using credits you have paid for, contact support@usemorphcam.com and we will restore the affected credits or issue a refund for the affected amount, at our discretion.
  6. We may change credit package pricing at any time. Changes do not affect credits already purchased.

6. Service availability

MorphCam relies on third-party infrastructure, including AI processing provided by Decart. We aim to keep the Service available and reliable, but we do not guarantee uninterrupted access. The Service may be temporarily unavailable for maintenance, updates, or reasons beyond our control.

7. Intellectual property

MorphCam, including its software, design, and branding, is the property of YOM Digitals Limited. These Terms do not grant you any ownership rights in the Service. You retain ownership of the original content you create using MorphCam, subject to your compliance with these Terms and the Acceptable Use Policy.

8. AI processing & watermark disclosure

MorphCam uses third-party AI face transformation services to process your webcam video in real time. By using MorphCam, you acknowledge and accept the following:

  1. AI processing is performed by an underlying third-party provider. MorphCam transmits your video stream to that provider solely to deliver the transformation feature.
  2. Depending on your active credit plan, the transformed video output may include a visible watermark applied by the AI provider. Watermarks are a function of the plan tier, not a defect in the Service.
  3. Users on free or trial access should expect watermarks to appear on their transformed video feed.
  4. A paid credit plan may remove or reduce watermarking, subject to the terms of the active plan at the time of use. We make no guarantee that any specific plan will be permanently watermark-free, as this is subject to the policies of the underlying AI provider.
  5. By using MorphCam, you acknowledge and accept this behaviour.

9. Termination

We may suspend or terminate your account if you violate these Terms or the Acceptable Use Policy. You may stop using MorphCam at any time. Credits associated with an account terminated for a policy violation are forfeited.

10. Disclaimers

MorphCam is provided "as is" and "as available", without warranties of any kind, whether express or implied, to the fullest extent permitted by law.

11. Limitation of liability

To the fullest extent permitted by law, YOM Digitals Limited shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of, or inability to use, MorphCam. Our total liability for any claim relating to the Service shall not exceed the amount you paid to us in the three months preceding the claim.

12. Changes to these Terms

We may update these Terms from time to time. We will update the "Last updated" date above. Continued use of MorphCam after changes take effect constitutes acceptance of the revised Terms.

13. Governing law

These Terms are governed by the laws of the Federal Republic of Nigeria.
